Interviewing Overqualified Applicants

A manager of a small business recently posted a job opening for a mostly clerical type job. A degree is not required and generally neither is judgment. She also put the level of compensation clearly on the job posting and worked very hard to not over exaggerate the importance of the position.

The problem is that nearly every applicant so far has been what I would consider overqualified. Most have a degree of some sort and have extensive work experience. She says that she not necessarily opposed to hiring someone overqualified people but she fears that once they get hired that they will be either unhappy or they will leave as soon as something better comes along.

She started thinking about how to word interview questions so that she can weed out those who will jump ship as soon as something better comes along and who will stick around. She doesn't think flat out asking will get an honest answer (as I have interviewed for jobs myself and can't imagine telling an interviewer something like that.)

This is a very common situation in a very competitive labor market. There are a number of factors are at play here. Who's to say what's overqualified? Is this a code word for ageism -- you're too old? If you're afraid someone is going to use your company as a resume builder and then move on, maybe it's time to do a market survey of salaries and get competitive. There are people that may see your company as attractive and would sweep floors just to get in the door. Not everyone's career is a smooth elevator ride to the top. Sometimes it's more like the kid's game "Chutes and Ladders" -- you move two spaces forward, land at the wrong place, and you're "downsized/rightsized" back three steps. So now you're "overqualified" but willing to do a great job for a company that will give you a chance. One of the reaons people hate HR and why HR professionals can't get a "seat at the table," is that HR people act like fortune tellers who can predict who'll be with the company 10 years from now (assuming HR hasn't downsized, rightsized, or resized them).

First, if your company is seen as an employer of choice, then people will see the position as a foot in the door. They will want to work for your organization in any capacity.

Secondly, many communities in the U.S. have a very low crime rate, universities, and several smaller colleges, arts, and sports teams which are criteria for most people who want to raise a family. Example of such communities exist in the state of Hawaii, which currently has unemployment rate of only 3.2 percent. People want to raise families in these types of communities are willing to accept positions below their qualifications in order to do so. These are the types of people that don't care how much they are paid as long as they are happy. A happy employee is a productive employee.

Most importantly, you should still make sure that the candidate agrees with the company's mission, philosophy and goals as that is where retention lives. At the same time be honest with the applicant; if there is very little opportunity for advancement, tell them. If they seek challenge, outline the kinds of challenges they are likely to face.

You also may find that people are looking for work that doesn't demand 60-80 hours per week of their time. I know several people who have left management for administrative positions so they could spend more time with their family.

I have left the corporate environment where I was an Assistant Grocery Manager. Since then I have operated all my companies from my home. I first was starting with a web design company with up to 15 employees at any given time, to my current HR consulting business with 3 employees. I have following in the footsteps of one of my friends in Hawaii who operates a successful mortgage broker business from his home Hawaii Kai. This is one of the most serene places to live and work in Hawaii away from the stress filled city limits.

There are many reasons why highly qualified people apply for more entry level jobs, including changes in their family life that might be requiring more time and energy than they have to give to a higher-level position. Or, they may be looking at making a career change, and are aware that some of their skills are transferable but are not sure about others.

Verify that the individual has read the job description (and be sure to provide one at the interview). You can also ask what it is about the position that has attracted them. You can also ask about what other types of positions they are applying for, including other companies, to get a better idea of whether they are just fishing for anything in a tight labor market, or are targeting a specific position or business type.

Keep in mind that as the baby boomer generation begins to retire, we are going to be faced with filling more and more positions with people who may have work experience and education that exceeds the job requirements. However, this also provides opportunities for organizations to re-evaluate positions to provide more growth and development opportunities for the incumbent to improve productivity levels without having to increase staffing levels.

With that in mind, there is yet another option here, and that is to create casual (on-call) positions for the baby boomers who are about to retire, and offer them these positions to keep them on board on a limited bases. Casual (on-call) positions are mostly found in the hospitality and retail industries. Examples of such companies that use casual positions include: Hilton Hawaiian Village, Sheraton Waikiki, Foodland, and Safeway. Baby boomers who are offered these types of positions can still enjoy semi-retirement, keep their skills fresh in case they want to come out of retirement, as well as keeping key skills with the organization.

Child Custody Laws And How To Best Deal With Them

In most of the cases, parents are given joint custody while sole custody is given in the case the other parent is not able to provide any sort of care to the child.

During custody hearings, the law puts a lot of emphasis on the will of the child. The judge has the provision to ask the child his or her preference. This would depend highly upon the ages of the children and whether they understand these things. The child custody law provides various visitation options for both parents depending on the ease of the child.

Child custody laws also have different provisions for disputes that arise during custody hearings. During disputes, the judge can try to mediate by bringing in a third party or can even exercise his right of giving legal custody to the parent if deems fit. Most of the times, the decisions are mutual between the parents and the judge; mutual decisions are considered to be the best for the child.

Child custody is a very important aspect for parents after the divorce, and parents should keep themselves well abreast with the basic laws of custody if and when the need arises to actually have them implemented in their lives.

Spider's Big Catch

When I was in college, Spider McGee, Charlie Fox, and I loved to fish off the log boom in the river near my house on summer afternoons. We'd sit and talk about life, drink hot chocolate, and occasionally catch a fish or two. But one day, Spider yelled, "Hey, I got something, and it feels big!"

Catching any fish--of any size--was always a surprise, but hooking something big was reason for genuine excitement. As Spider began to reel, his pole bent almost in half.

"This thing is a monster," he said, the drag on his reel screaming.

After twenty minutes or so, he'd gotten it close enough to the boom to get a glimpse of his catch. It was a snapping turtle.

"Ah, man, that's too bad," said Charlie. "I thought maybe you had Old Granddad there, for a second. Cut the line and let him go."

"Are you crazy?" said Spider. "That lure was given to my dad by his grandfather. It was hand-carved in Norway--and he doesn't even know I borrowed it! I gotta get it back."

"Well, how're you gonna do that?" I asked--and was soon sorry I had.

"I'll just bring him up to the edge of the boom, and you guys reach out and grab it," Spider said calmly.

Now, I'm dumb, but I'm not stupid.

I said, "No, no, no--you bring him to the edge of the boom, and then I'll try to pry the lure loose with a stick."

"OK, that'll work," said Spider.

As Spider struggled to bring the turtle close to the edge of the boom, Charlie handed me a long stick. I reached out, and the turtle's jaws instantly clamped down on the stick. I lifted him out of the water, and we headed toward the bank.

Once on shore, we set the angry turtle on the ground, but he refused to let go of the stick, the lure still dangling from the corner of his mouth. I reached out with my tennis shoe to nudge him in the back, and instantly learned several interesting things about snapping turtles. First, they're not as slow as you might think, second, they're very agile, and third, they're well-named.

In a heartbeat, the turtle's neck shot out, reached completely behind him, and bit through the end of my sneaker. Then, spitting out rubber and nylon, he turned and looked at us menacingly.

"OK, we need a new plan," said Spider.

"And a new pair of shoes," I added, looking down at my big toe, which was now plainly visible through the hole in my shoe.

"You hold his head down with the stick, and I'll reach out and grab the lure," Spider said.

It was an insane plan, but it was still a step in the right direction, I thought. At least, there wouldn't be any parts of my anatomy at risk this time. I took the stick and pinned the turtle's head to the ground while Spider got down on his belly and crept slowly toward the angry, struggling turtle.

It was then I learned even more lessons about snapping turtles. First, their front feet can be used a lot like a pair of hands, and second, snapping turtles are much stronger than you might think.

The turtle reached up and quickly pushed the stick away and quickly raised his head--now leaving him face-to-face with a very surprised Spider McGee.

The big guy screamed, which was probably the best thing to do at the time, since it caused the startled turtle to reach up with a front foot, pop the lure from its mouth, and then it whirl around and head back toward the river.

While all that was going on, the lure leapt through the air and finally came to rest--firmly lodged in Spider's left ear. He danced around in pain, but we finally managed to pin him down and cut the line from the lure. Then we packed up and loaded him into the car.

All the way home, Charlie and I would occasionally look back at poor Spider, sitting like a sad puppy in the back seat and wearing what looked like a giant hand-carved, bug-eyed earring. Then we'd look at each other--and laugh.

All that happened more than 30 years ago, and although Spider didn't know it at the time, he was a trendsetter. He was the first guy I ever knew to wear an earring, even if he'd had to get his ear pierced by a snapping turtle to do it.

I'm pretty sure they have easier ways of doing that nowadays.

I am Doing What?, or The Art of Procrastination

Procrastination, a beautiful word for an interesting behavioural trait in us humans.

The word procrastination (even trying to spell it on the computer is an art...) is a derivative of two Latin words: "pro", which means "forward", and "crastinus", an adjective which translates to "what will be tomorrow", "of tomorrow". Procrastination therefore literally means "move forward to tomorrow", or "to adjourn".

In coaching we use the term more technically, to describe the behaviour we ALL display every now and then (or often!): putting things off until "another day", so that we don't have to do it today. I jokingly call it the "Mañana-syndrome", referring to popular jokes about the Spanish speaking population, who, when you ask them to do something for you reply: "Mañana, señor!" (i.e. tomorrow, sir!).

Examples

Many amongst us proclaim: "I don't do that! I never procrastinate!". No? Well, when you recognise one of the below statements in yourself (or others), you belong to the human race! We ALL procrastinate, some more, some less, some often, some less often:

o your house is a mess, and you know you have to clean it, but you'd rather go and have coffee with a friend, or decide to suddenly phone a relative, and after two hours realize it's now time to get the kids from school, and you cannot clean the house anymore!

o you are at work and things need to be done, but you go from one person or office to the other, chatting and drinking something, socializing and sending e-mails and sms-es until the cows come home, without finishing your job;

o You've been waiting MONTHS (or even YEARS) to write something in a journal, or to write a book, but something else always seems to have priority, or seems to stop you from starting;

o You would like to start a business or another (ad)venture for yourself, but feel that you -every time- need to do or know just that little bit more, or read just that one extra book, or take just that one extra course to be really ready for it;

o Times or tasks get rough, and you decide to talk a walk; literally. You walk away from the task at hand, distracting yourself, or even more drastic, you go and travel around the world for a while, or relocate to another town, only to find that the same problems pop up there;

o You are aware of things that need doing, but there always is somebody or something that needs your help right now, so you "need" to address that situation first, before getting around to your own stuff;

o You fill your days cleaning up, filing stuff, organizing, getting everything in order, only to find there is no more time left to tackle the important tasks;

o You are ready to ring for that new job, to get that new client, to tell your boss you really need that raise, to call your loved one to express your emotions fully, to go and visit a friend you haven't seen over 10 years, to start eating healthily, but then.........ah, well, not today. Tomorrow I'll definitely do it! Really;

o You just do not want to know. You go into "zombie-mode", not taking any responsibility at all, forgetting about appointments and agreements, and living in a daze. You are not sure what's going on, but don't really think about it either.

Sounds familiar to one degree or another? I dare to bet with everyone who reads this that you have or have had times where one of the behaviours above showed up. Nobody is totally free of procrastination.

Sneaky

Can you see how sly procrastination really is? You cannot say that procrastination is something that you can point at; it is not tangible. It usually shows up in "cloaked" ways, behaviours that might seem very sensible or even praiseworthy (eg. helping others), but are meant to yield one result only: NOT having to do or work on the project you need to, but do not want to.

Just be honest with yourself for a couple of minutes, and search your mind for things that you feel need to be done or finished, but still aren't (for various reasons). It can be anything from not finishing the renovation of the master bedroom to signing up for that long-desired gym membership. And be strict: "no time" is NOT a good reason to leave something undone. In that case you should have taken less on your plate.

The feeling side

So how do you feel when you procrastinate? Does it make you feel great or grouchy? Good or bad? Does it leave you smiling at yourself, or can you feel a little guilt bubbling up inside?

In reality, procrastination does not have any emotional charge of itself. It just "is". You were meant to do something, and you don't. Big deal. Nothing to it. What makes it this emotionally charged monster is because we live by values, beliefs and rules about what is good and bad, right and wrong. Usually, not finishing things that we were supposed to do falls under the category "not good". We stick an emotional label on that behaviour, saying that we should not behave like this. It is THAT thought that leaves us with the bad taste, not the procrastination itself.

Domino effect

The label being put on the act of procrastination is the one that initiates a cascade of other negative thoughts and events in our lives, that usually leads us to procrastinate even more. Here are a couple of examples:

o the fact that we procrastinate makes us fearful en doubtful. We start to fret about not getting things done, which makes us feel even worse, and paralyses us;

o Our own feelings of self-worth diminish. As we feel we cannot get things done and feel bad about it, we subconsciously start to filter for more of that behaviour, and will definitely find it. That brings our self-worth down even further, and creates a poor self-image. That, in turn, reduces our expectation of success, and we then want to procrastinate more, etc. etc.;

o We will create a poor reputation with others, who will then not throw exciting opportunities to us any longer, because we do not follow up;

o We will start to think that we are "good for nothing", so why should we bother in the first place to get things done.

Why do we do it?

The one and only reason that we procrastinate is FEAR, False Expectations Appearing Real. Whether is it fear of success, fear of failure, fear of not being good enough, fear of being rejected, fear of change, fear of making mistakes, fear of having to live up to expectations, fear of the unknown, it is the fear in us that makes us choose the comfortable over the uncomfortable, the sitting still instead of the moving forward. And that is okay. There is nothing wrong with being afraid. The only question you will have to ask yourself when you are procrastinating -the golden rule that guides my life- is:

Does this behaviour honour me, and is it effective?

If you answer "no" to any of the two parts, it might be time to come clean, and reassess your actions -or lack of them- up to that point. It is time for change!

What can be done?

There are a number of solutions for the stale-mate position of procrastination, yet they all start with the open and honest realisation that you ARE not doing what you feel you should, and you DO NOT like that feeling. You cannot hope to solve problems that you do not recognise or acknowledge.

From then on it is not that hard, really.

1) One of the things to do is to consciously change the interpretation you have given to the non-action. Instead of beating yourself up, feeling guilty, feeling useless, or feeling powerless, you could look at it this way:

o it may not be the right time to act yet; a wall that's destined to fall over will not do so before its time; pushing against it will not help. Feeling guilty about the fact you cannot make it fall neither;

o you are preparing yourself for the "big move" forwards;

o you ultimately WILL take action;

o the previous non-action was just a mistake;

o procrastination in one area does not mean your whole life is motionless;

o by procrastinating up till now you are able to clearly see what you do NOT want, so now you have got more options to decide what you DO want;

o Procrastination is not a bad thing; it's just the label you put on it that makes it so.

If you are able to look at your idling this way, you will find not only that you will feel better, but also that you will attract opportunities in your life that allow you to take action at the appropriate time to do so. The governing law in our universe is the Law of Attraction, loosely paraphrased as "what you focus on is what you will experience". If you focus continually on what has not been done, you will find plenty more things that have not been done. That's how simple our mind works. If, on the other hand, you focus on the temporality of the lull, it allows you to prepare yourself for the more important things that are to come. And as your focus changes, what you draw into your reality changes; for the better, I might add!

There is NO WAY that you will not (ever) procrastinate. It is just a fact of life. What does matter is, how you react (or rather: respond) to it. Do you let it bring you down, or will you use it as leverage to jump even further?

2) Another solution is more "coach" oriented. It revolves around "taking action!". Coaches love it when clients take action. Propel yourself forward, be scared and do it anyway; that sort of attitude. Here are a couple of ways to take that necessary action that will overcome procrastination:

o GOALS: Get clarity on where you want to go by setting goals for yourself. You might be surprised how many people have no clue where they want to go with their lives. No wonder they do not take any action; why would you if you do not know what for?

o CLARITY: When you have a clear outcome, everything becomes a lot easier. Goals are best formulated in short sentences where you claim a state of being, either by saying "I have" or "I am", and then finishing it in present tense. Make sure there is a "final step", something you know is the evidence of your goal achieved. For instance, if you want to earn a certain amount of money, you might formulate the goal this way: "it is 10 July, and I am sitting in the kitchen reading the bank account statement. It shows that I have $....... in my account".

o HELP: yes, you have to take personal responsibility for everything that goes on in your life, but hey, asking help is a great way to move yourself along. Get a coach, hire a personal assistant, ask a friend to challenge you, pay some money and get somebody to do the stuff you do not want to.

o CLEAN: make sure you remove all unwanted objects and tasks from your mind's eye. Get rid of "old stuff", whether physical or mental. Old hobbies, old relationships, old habits. Dump as many as you reasonably can, and create a new, clean space to think and work from. Your actions will come more easily that way.

o PLAN: when you have more structure, you will have more clarity, and chances are that the whole mess of "stuff" you were looking at before is not so bad anymore! Diarise things, get a planner, be strict but flexible with how you divide your time. Make a list of "to do" things, and put a time limit on them. Do important things first, and then the less important ones.

o TIME OUT: take regular time outs. You need them. Don't take that many that they become part of your procrastination strategy (we humans are very intelligent beings......), but definitely take frequent "helicopter snapshots" of where you are by stepping away from it all. The more you are in the swamp of all that you have to do, the less incentive there is to actually do it. When you refresh yourself and look at it all from the outside edge of the swamp, the less daunting it looks.

There are lots of ways to overcome the inertia, and to get you moving into the desired directions. Procrastination is the art of perceiving life as being stuck, not moving, inert. That's a conscious choice, given the fact that everything in life moves (energy flows) all the time. If that is the case you can also make the conscious choice not to see life that way anymore, and become more aligned with the "universal laws". You'll find that, when you do, life becomes a whole lot easier, and much more fun!

Helping the Person With Autism Manage His Anxiety

"I cannot 'come back' and defend myself. I cannot respond to others. This is scary, beyond scary. It is terrifying. Sometimes the words seem to be accessible, but as I open my mouth they disappear. In the presence of another, I instantly forget what I was going to say. This happens over and over. I want to talk, but I forget what to talk about. It feels like I am a blank slate. It petrifies me. People on the 'outside' expect me to talk. What am I going to do? Sometimes I watch very carefully to see what would be a good answer and give them back what they want. I am good at this. I feel this is the only way to survive. Survival is becoming my middle name. Who would ever understand that I am a blank slate? When I am alone I am not blank, but in the presence of others, I am. I am a blank slate walking around in a person's body. Please help me. This is too much for me to know. Who will listen to my burden?"

Let us make sense out of this autistic child's experience. We can only deduce what is going on within him. He seems to be telling us he has no ability to respond to others and this scares him very much. He says to wants to talk, but in the presence of others, he goes blank. By himself, he is not blank, can form ideas, and probably has feelings. Finally, he feels burdened by this experience and there is a sense of hopelessness and desperation in his writing. We can understand this experience as a lack of freewill and control over his environment.

This child is describing the experience of not being able to express himself as he sees others do. It is a tortuous experience, which he seems to lack the ability to change on his own. I believe it is important to note that this phenomenon is probably going on with others with autism spectrum disorders as well. He is describing how relationships cause him tremendous anxiety and cause him to collapse. He is not 'falling apart' because he wants to, but because of his anxiety when in relationship to others.

How can we help this child who seems to collapse when in relationship to people? Some steps that may be helpful for the child with autism and yourself are 1) recognize that he has the potential to communicate, but the presence of another makes him feel too anxious and he 'goes blank' or forgets what is on his mind, 2) he is not going blank because he is willful or difficult, 3) help him to understand that you understand his predicament, 4) help him to become more comfortable with others including you. Until his anxiety is under control he will continue to go blank and finally 5) give him the time and space to talk. Create opportunities for the two of you to dialogue.

Anxiety is something that people on the spectrum are always trying to manage. We need to put ourselves in their shoes. If they lack self-agency and dissociate in the presence of others, which creates an inability to communicate their needs than their daily existence will be one of coping and anxiety management. People in general remain anxious when they do not have a way to self-regulate. 'Typical' people talk about their problems with others and hopefully find new solutions to manage a given situation or their anxiety in general. Because people with autism do not have the ability to communicate their feelings, we have to find other methods to help them to self-regulate.

What can we specifically do to help the individual with autism who is anxious? There is not an easy answer, but some thoughts to consider: 1) talking about anxiety in general may be helpful. If the child is nonverbal, speak about how he might be anxious doing the specific thing he is doing. If he does have words, ask him either how he is feeling or interpret what his anxiety might be like. Let him respond to you. It is important to not expect that he will be able to speak about his anxiety, but at least allow this to be part of the discussion between the two of you. By doing this he is acknowledged for how he is feeling and hopefully in turn feels understood, 2) make room for the discussion of anxiety as part of the dialogue, 3) let him have the time he needs to warm up to new situations and not be pressured to comply to others' time frames and 4) work on developing a relationship with him that allows for mutuality, dialogue and direct expression of feelings.

The Florida Handbook 2005-2006 (Book Review)

There is so much to learn and to know about Florida that even the not-so-recent newcomers and residents of several years like me rejoice when they find "The Florida Handbook 2005-2006" in their hands. This book's 820 pages have been compiled by Allen Morris (now deceased) and Joan Perry Morris, both Florida historians and authors.

From the members of The Executive Branch of the State of Florida to noted residents and people who wrote or had anything to do with the history of Florida, all biographies and photographs are meticulously put together throughout the book. In addition, information on major state agencies and Florida's budget are offered in detail. I was surprised to read the clearly written main points of the Sunshine Amendment and the Sunshine Law.

For those who may be curious, Sunshine Amendment provides a right of access to governmental proceedings at both the state and local levels. It gives a constitutionally guaranteed right of access to residents and the Sunshine Law applies to all discussions or deliberations as well as the formal action taken by a board or commission. Almost all state and local public bodies are covered by the open meetings requirements with the exception of the judiciary and the state Legislature.

After the Executive Branch, the book continues with the Judicial System and the local governments of the state, followed by Artists Hall of Fame, Great Floridians, Symbols of the State, Florida forts, Native Americans, Early Florida Cemeteries, Floridians at War, Florida Counties, Florida Literature, Everglades, Exotic Plant and Animal Species, Climate and Weather, Sports in Florida, Florida Forests,State Parks, Citrus Production and Processing, Florida Mineral Industry, Fish and Wildlife, General Farming (Trucking, Crops, and Livestock), Public Education, Highways (Trails to Turnpikes), Notable Bridges, Scenic Drives, Size and Structure of Florida, People, Economy, Utilities, Motor Vehicle and all related services, Elections and a few lists and charts.

To the end of the book, Florida's Constitution with all its articles and amendments are added. The book has an index as well.

It was interesting to read that Florida became a state on February 11, 1845, and the county I live in--St. Lucie--was accepted as the 25th county on March 14, 1844. Then it was accepted again, after its creation for the second time, as the 46th county on May 25, 1905. Floridians, surely, have a special way of doing things.

Inside the book, all the noted individuals of the state are given detailed biographies with photographs. As a bonus, some wonderful old and new photographs decorate the book in black and white.

From a personal standpoint, my attention was directed to the section on Florida literature written by Helen Muir. The first known work written in Florida is "Fontaneda's Memoir" in fifteenth century. In this section, Marjorie Kinnan Rawlings, Hemingway, Audubon, John Muir, Henry James, Stephen Crane, W.C. Bryant, J.F. Cooper, Harriett Beecher Stowe, Kirk Monroe, Marjorie Stoneman Douglas, Zola Neale Hurston, Michael Shaara, Joy Williams, Laurence Shames and the writers and journalists who came after them and who have had anything to do with Florida are given their places. In 1994, Robert Frost Poetry Celebration was established, and The International Book Fair in downtown Miami is celebrating its 23rd opening in November 2006. As the writer says, "As Florida grows, so grows its literature."

I came across this book in a Borders bookstore. When I wanted to send it as a Christmas Gift to a friend from online, I couldn't find it in Amazon or in another online bookstore. The book as the 30th Biennial edition is published by Peninsular Publishing Company with ISBN 0976584603.

The Florida Handbook 2005-2006 can be a fine edition to any school, home, or public library because of its meticulously compiled information and priceless photographs.

Employees are critical to any business other than the smallest ones. That being said, the tax requirements for dealing with employees can be a pain in the derriere. The problems are many, but one particular situation puts employers in a very bad spot.

Withholdings on employee paychecks is a subject that can cause tension in a business. Inevitably, some employees will want to reduce the withholdings from their check beyond the norm. The employer, in turn, is faced with the prospect of the IRS focusing unwanted attention on the business because of such actions. In a worst case scenario, the IRS will send a lock letter setting the amount of the withholdings. This puts the employer in the bad position of telling the employee more money must be withheld - a situation sure to cause tension. Making matters worse, the employer was supposed to be able to determine when the employee was abusing the withholding process.

The IRS has issued regulations that at least relieve the employer of the burden of determining if an employee is stepping over the line on the reduction of withholdings. Whereas the employer was previously required to send a W-4 Withhold Allowance Certificate to the IRS if an employee was claiming a total exemption from withholdings or more than 10 allowances, it no longer does. As of April 14, 2006, the IRS will simply make its own determination using salary filings for the business in general.

This regulation modification by the IRS should be applauded as a significant boost to employers. No longer does an employer have to act as a detective in determining whether an employee is not paying in enough tax on paychecks. Instead, the employer can now sit back and wait for the IRS to act. If the IRS feels an employee is out of line, the agency will send a lock-in letter to the employer. The employer than has no choice but to comply. Employees are much more likely to understand this and focus their anger on the IRS instead of the employer.

The new withholding regulations represent a positive step by the IRS. They might just keep employers out of the tax problems of employees.

When this happens, it can be hard to remember what to do at the scene of an accident.
